Abstract
In this study, in which the qualitative research method was used, the approach of Ab? Bakr al-Asam (d. 200/816), one of the important representatives of the Basra Mu?tazil? school, to some fiqh issues was discussed together with its evidence. In addition, for comparison purposes, the opinions and conclusions of the sectarian scholars representing the majority were also touched upon. As far as we have researched, although there are many books attributed to Asam in the sources, his works have not survived to the present day. However, it has been determined that Asam's views are included in many fiqh sources. Consequently, the works of many scholars have been examined thematically in order to reach the views and evidence attributed to him. In the works examined, it is seen that Asam presents many evidences to ground the fiqh issues and mentions narrational evidences as well as rational evidences. However, in addition to his sometimes rational and sometimes unfounded evaluations, his failure to take into account the religious evidence on relevant issues or his occasional use of interpretations against the sunnah have been seriously criticized by scholars. This led to him being accused of blasphemy. On the other hand, it is stated in the sources that he was deemed worthy of praise for his curiosity in science, his scientific competence among Mu?tazil? theological scholars and many other issues. Therefore, in this study, Asam's brief biography will be presented, his fiqh views, which are the focus of criticism, will be discussed, and the relevant views will be evaluated together with their evidence. © Published by Aksaray Üniversitesi İslami İlimler Fakültesi / Aksaray University Faculty of Islamic Sciences, 68100, Aksaray, Turkey.
