| dc.description.abstract | Bu çalışmada, Medeni ve Siyasal Haklara İlişkin Uluslararası Sözleşme (MSHİUS)’nin denetim organı olan İnsan Hakları Komitesi (Komite) kararlarında ulusal güvenlik gerekçesiyle ifade özgürlüğünün sınırlanması incelenmiştir. Kararların incelenmesine geçilmeden önce, kısaca, MSHİUS’da güvenceye alınan haklar, Komite’nin yapısı ve denetim yöntemi üzerinde durulmuştur. İnceleme sonunda, ulusal güvenlik gerekçesiyle ifade özgürlüğünün sınırlandığı iddiasıyla Komite’ye sınırlı sayıda başvuru yapıldığı, Komite’nin bu başvurular karşısında, çok ayrıntılı olmasa da, ifade özgürlüğünden yana bir yaklaşım sergilediği söylenebilir. | en_US |
| dc.description.abstract | This study examines the limits to the freedom of expression due to national security in the decisions of the Human Rights Committee that is the auditing body of the International Convention on Civil and Political Rights. Before the analysis of the Committee decisions, the rights that are protected by the Convention, the emergence, structure, the method of audit of the Committee will be described. The analysis of the decisions shows that there is a limited number of applications with the claim of limitation of the freedom of expression due to national security and also that the Committee has an ambigious and relatively reserved attitude towards the applications. | en_US |
